Terms of Service.

Part A covers your use of this website. Part B covers the web design services we build for you. Written in plain English, governed by the laws of New South Wales, and nothing in here takes away rights you already have under the Australian Consumer Law.

Part A — this website

A1. General information, not advice

The content on hekaweb.com — pricing guides, blog posts, calculators and FAQs — is general information for businesses in Australia. It is not legal, financial, accounting or professional advice, and it is not a quote. A fixed written quote is only ever issued in response to a specific enquiry.

A2. Intellectual property

The content of this website — text, design, code, illustrations and the HEKAWEB name and logo — is our intellectual property. You may browse, link to and share it with attribution. You may not copy, republish or sell substantial parts of it without our written permission.

A3. Links and third parties

Occasionally this site links to third-party websites (for example, the Office of the Australian Information Commissioner). We are not responsible for the content or accuracy of external sites.

A4. Availability

We work hard to keep this site fast and available, but we do not warrant that it will be uninterrupted or error-free, and we may change or withdraw content at any time. To the maximum extent permitted by law, we are not liable for any loss arising from your use of, or inability to use, this website.

Part B — our services

These terms apply to any web design or development work we do for you. They sit alongside — never instead of — the fixed written quote issued for your project, and the specific quote prevails if the two ever disagree.

B1. Quotes

Every project starts with a fixed written quote: a set price, a set scope, a set timeline. The price on the quote is the price you pay. If your requirements change mid-build, we agree any variation in writing before the extra work starts.

B2. Design first, pay later

You pay nothing upfront. We design your finished site and you approve the design before any money moves. If you don’t approve it, you walk away owing nothing. On approval, a 50% deposit begins the build. The balance is due at launch, and the site goes live when the final payment lands.

B3. Pay-it-off plans

Eligible projects (including new-business specials) can be paid off over 12, 24 or 36 months. The total is the quoted price plus one fixed 10% arrangement charge — shown upfront, no interest, no compounding. You pay 10% down and the remainder in fixed monthly instalments. The design-first approval still applies before the plan starts, your site goes live and works from day one, and ownership transfers on the final payment. Paying in full remains the cheaper path.

B4. Free edit window

Every build includes a free edit window after launch: 30 days on Launch, 60 days on Signature, 90 days on Empire. Inside the window, anything broken, off-brief or not performing as agreed is fixed free.

B5. Changes after the window

After the free edit window, new pages, new features, restyling and routine content updates are billed at $150 per hour, quoted before work starts. Alternatively, HEKAWEB Care at $99 per month covers hosting, monitoring, a priority queue and up to two hours of content updates each month — cancel anytime.

B6. Hosting

Hosting is free for most sites on our edge network. Large builds — e-commerce, web apps, 12+ pages — move to managed hosting from $49 per month. You can cancel anytime and move to any host you like; you own everything either way.

B7. Ownership and intellectual property

Until final payment, the intellectual property in the work we create for you remains with us. On final payment we transfer it to you in full — private Git repository, cloud archive, and a signed IP transfer deed. From that moment the code is legally, provably yours: host it anywhere, hand it to any developer, sell it with the business. Third-party tools embedded in your build (for example a payment processor or CMS) remain subject to their own licences.

B8. One client per industry, per area

To avoid conflicts of interest we take on one client per industry, per local government area — first come, first served. Once a slot is taken for your industry in your LGA, we decline competing work there for the life of the engagement.

B9. What we need from you

Timelines depend on timely input: the brief, your content, logos, photos and approvals. Delays on your side shift the launch date accordingly, and we will always tell you plainly when that happens.

Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where a consumer guarantee applies and is breached, you are entitled to the remedies the law provides.

To the maximum extent permitted by law, and subject always to those non-excludable rights, our total liability for any claim relating to our services is limited to resupplying the services or paying the cost of resupply. We are not liable for indirect or consequential loss — lost profits, lost revenue or lost business opportunity — to the extent the law allows that limitation.

Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute arising from this website or our services is subject to the exclusive jurisdiction of the courts of New South Wales — although we would much rather sort any disagreement over a phone call.
